Appellant was committed to the California Training School for Boys as a child of unsound mind. He was released from such custody on September 20, 1932. On October 3, 1937, he was sentenced to the state prison for the term of his natural life. This order was entered pursuant to section 2109 of the Welfare and Institutions Code.
On December 5, 1937, a petition was filed by the probation officer praying that appellant be committed as a ward of the court pursuant to section 6550 of the Welfare and Institutions Code. In the same petition it was alleged that appellant, at the time of the commission of the crime of which he had been convicted, was a juvenile and was in the custody of the probation officer. Respondents filed their answer in which they admitted appellant had been convicted of the crime of which he was convicted but denied other allegations of the petition.
On January 8, 1938, the petition was granted and appellant was ordered committed to the California Training School for Boys as a ward of the juvenile court. Appellant filed his motion to set aside the order granting the petition and his motion for a trial by jury in the superior court. These motions were granted, but upon the state’s motion a new order was entered in which the order was vacated and on the court’s own motion appellant was ordered discharged from the custody of the probation officer.
